The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 307, 353, 504, 506, 34 of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons including petitioners alongwith 15-20 unknown persons surrounded the informant and started abusing and assaulting him. It is further alleged that petitioner no. 2 pressed the neck of informant and pushed him down, due to which, he became unconscious.

It is submitted on behalf of petitioners that as a matter of fact, a title suit, vide Title Suit No. 157 of 2019, is going on

Patna High Court CR. MISC. No.37170 of 2022(2) dt.17-11-2022 2/2 between the parties, which has been filed from petitioners' side, and due to which, a simple scuffle took place, in which, informant sustained injury, which is simple in nature. Petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Hisua P.S. Case No. 108 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
