Learned counsel for the petitioner is permitted to make necessary correction in paragraph no.3 of the application. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner, who is languishing in custody, seeks bail in a case registered under section 395 of the Indian Penal Code, is one of the named accused.
In this case, instituted against two named and four unknown, petitioner's name appears emerging during investigation allegedly on being apprehended after some chase and on recovery of fire arm another case being Gurua P.S. Case No.51 of 2014 has also been instituted.
Submission is of false implication on baseless suspicion. Further petitioner carries no criminal antecedent except one case as stated above arising in same sequence.
If it is so, the petitioner above named is directed to be
Patna High Court Cr.Misc. No.45138 of 2014 (2) dt.04-02-2015 2/2 released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gurua P.S. Case No.50 of 2014, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
