The petitioner seeks anticipatory bail in connection with Chandauti P.S. Case No. 185 of 2016, registered for offences punishable under Sections 302 and 120 (B) of the Indian Penal Code.

As per F.I.R., the informant got an information in the morning of 16.06.2016 from the Chaundati police that a dead body was lying having I. D. Card and later on identified as the brother of the informant and it is suspected that the petitioner along with other accused persons have committed murder due to dispute of transaction of money. Submission of the learned counsel for the petitioner is that only on the basis of suspicion, he has been implicated in this case and after investigation, submitted final report against

Patna High Court Cr.Misc. No.1727 of 2019(2) dt.04-02-2019 2/2 the petitioner but the cognizance has been taken against the petitioner and the petitioner has no criminal antecedent. Heard learned A.P.P. as well as learned counsel for the informant opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Chandauit P.S.Case No. 185 of 2016, to the satisfaction of Smt. Surabhi Srivastava, learned Judicial Magistrate 1st Class, Gaya, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
