JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 13.11.2019 in connection with Kutumba P.S. Case No. 139 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Petitioner happens to be own Sarhu of the deceased and, allegedly, he had illicit relation with wife of the deceased. In course of investigation, informant and other witnesses claimed that petitioner committed murder of the deceased on account of the above stated illicit relation but, admittedly, none had seen the actual killing of the deceased nor any witness came forward to say that on the alleged date of occurrence, petitioner was present in the village, where alleged occurrence had taken place. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XIV, Aurangabad (Bihar)/concerned court in connection with Kutumba P.S. Case No. 139/2019 (S.T. No. 88 of 2020/77 of 2020.
