The petitioner apprehends his arrest in Saur Bazar (Patargat O.P.) P.S. case No. 27 of 2012 registered under Section 363, 368, 371, 504, 120B of the Indian Penal Code. The informant alleged that petitioner and Raj Kumar Paswan took his son Gopal Paswan for providing him employment in Delhi but his son did not return. The learned counsel for the petitioner submits that son of the informant went along with the petitioner and Raj Kumar Paswan to Delhi for getting job. The witnesses have stated that son of the informant went to beetle shop and thereafter nobody saw him. Save and except suspicion, there is no material against the petitioner. Similarly situated accused Raj Kumar Paswan has already been granted anticipatory bail vide
Patna High Court Cr.Misc. No.79170 of 2018(2) dt.25-01-2019 2/2 order dated 20.09.2018 passed in Cr. Misc. No. 46921 of 2018. Taking into consideration the fact that save and except suspicion there appears no tangible material against the petitioner and similarly situated accused, Raj Kumar Paswan, has already been granted anticipatory bail, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saur Bazar (Patargat O.P.) P.S. case No. 27 of 2012 , subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
