JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-04-2019 The petitioner apprehends his arrest in connection with Khagaria P.S.Case No. 84 of 2017 registered under Sections 379 and 120B of the Indian penal Code.
Allegation is of theft of a truck of the informant and he suspected the hand of Cleaner Sajan Kumar. Petitioner is not named in the FIR and later on, during course of investigation, his name transpired.
Submission of learned counsel for the petitioner is that as a matter of fact, petitioner was earlier driver in the truck and there was dispute arose with respect to demand of wages and as such he was assaulted and removed from service and for that he has lodged a complaint petition which is Annexure-2 of this application and so far the confessional statement of Cleaner Sajan Kumar concerned, he is changing time and again and as

Heard learned APP and learned counsel appearing on behalf of the informant, who have opposed the prayer for anticipatory bail.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, on his surrender , provisional bail granted vide order dated 16.01.2019 shall be confirmed.
