2. The petitioners seek bail in Gadhara P.S. Case No. 27 of 2026 registered for the offences under Sections 324(2), 190, 126(2), 115(2), 74, 303(2), 352, 351(2) of BNS and Section 12 of the POCSO Act.
3. The allegation is that the twelve year old daughter of the informant had gone to fetch milk, and it was there that Md. Mokaram, the Petitioner No. 1, attempted to kidnap her. He also attempted to run over the said daughter with a motorcycle. When the daughter tried to raise an alarm, a number of persons,
Patna High Court CR. MISC. No.33838 of 2026(3) dt.24-06-2026 2/3 including the petitioners, arrived armed with a pistol and pressurized the informant to withdraw Gadhara P.S. Case Nos. 10 of 2022 and 87 of 2025.
4. Learned counsel for the petitioner submits that the petitioner is in custody since 03.03.2026 and there is a history of animosity between the parties.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering that there is a history of animosity between the parties and the petitioner is in custody since 03.03.2026, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Chief Judicial Magistrate, Begusarai in connection with Gadhara P.S. Case No. 27 of 2026.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not
