JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Nanpur P.S. Case No. 64 of 2015 registered for the offences punishable under Sections 323, 498A, 494 and 504 of the Indian Penal Code.
Allegation against the petitioner is that he performed marriage with the complainant and thereafter again married with another lady and after committing physical and mental torture with the complainant the petitioner and others fled away leaving the complainant and her minor daughter.
Submission of learned counsel for the petitioner is that he is ready to keep her but the same has been opposed by learned counsel for the opposite party No.2 stating that
Patna High Court CR. MISC. No.55247 of 2016(11) dt.25-06-2019 2/2 petitioner has married with another lady and left the complainant along with her minor daughter and no expenses has been given to her and she has filed a maintenance case in the Family Court at Nagpur.
Heard learned APP also.
In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail and if petitioner is ready for settlement, the court below shall consider the same and pass an appropriate order on the bail petition. With the above observation, this application is dismissed.
