JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2024 At the outset, learned counsel for the petitioners submits that during pendency of this bail petition, petitioner no. 1 namely MANOJ KUMAR SINGH @ MANOJ SINGH has been arrested and as such, this petition has become infructuous so far as petitioner no. 1 is concerned.

2. The anticipatory bail petition stands dismissed, so far as petitioner no. 1 is concerned.

3. The petitioners (i.e. petitioner nos. 2 to 5) apprehend their arrest in a case registered for the offence under Sections 341, 323, 324, 325, 307, 379, 504, 506, 34 of the Indian Penal Code.

4. It is alleged that all the F.I.R. named accused persons including these petitioners assaulted the informant and his family members, as a result of which, two of them sustained grievous injury.

5. It is submitted on behalf of petitioners that due to land dispute between the parties, a simple Maarpeet took place in which both sides sustained injury. There is case and counter case.

6. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that the injuries caused by petitioner no. 3 & 4 are grievous in nature.

7. Considering the nature of injury, the prayer for anticipatory bail of petitioner no. 3 & 4 is rejected.

8. However, considering the fact that petitioner no. 2 & 5 are ladies and there is no specific overt act against them, in the event of their arrest/surrender within a period of six weeks

No.38443 of 2024(2) dt.11-07-2024 3/3 from today, let the petitioner nos. 2 and 5, as named above, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Saran at Chapra in connection with Taraiya P.S. Case No. 39 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
