JUSTICE SUDHIR SINGH ORAL ORDER 10-06-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State, as also learned counsel for the informant. The petitioner seeks bail in Ahiyapur P.S. Case No.388 of 2014 registered under Sections 302,120(B),34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case, in brief, is that the father of the informant along with the petitioner had gone to meet one Ajay Singh. On enquiry by the informant, his father informed that he was with the petitioner, Ajoy Singh and Suresh Gupta at the Market. Lastly, the informant went to find out his father along with co-villagers to the house of one Suresh Gupta, where he was found lying at the gate of the house in injured condition. The informant took his father to S.K.M.C.H. where he was declared dead. It is further alleged that the petitioner had taken loan of

On behalf of the petitioner it has been submitted that as per the allegation, the petitioner had accompanied the deceased on the motor cycle of the deceased and later on the dead body of the deceased was found. Apart from this, there is no other evidence to suggest that the petitioner has committed the murder of the deceased. It is further submitted that there is no eye witness to the occurrence. Further it is submitted that except last seen, there is no substantial evidence even to suggest that the petitioner has committed the murder of the deceased. It is also submitted that the petitioner is in custody since 12.1.2015. On behalf of the State and the informant, it is submitted that there was a money transaction between the parties and for the said reason, the deceased has been done to death.

It is further submitted that the petitioner, on the basis of the aforesaid evidence of last seen, has been made accused in the present case. Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in Ahiyapur P.S. Case No. 388 of 2014.
