The petitioner seeks regular bail in connection with Special Case No.3412 of 2019 arising out of Budha Colony P.S.Case No.121 of 2019 registered for offences punishable under Sections 341, and 323 of the Indian Penal Code and Section 37(ii) of the Bihar Prohibition and Excise (Amendment) Act, 2018..

Allegation against the petitioner is of assaulting the informant in drunken condition.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and he is in custody for about two months, having no criminal antecedent. Heard learned A.P.P. also.

No.30558 of 2019(2) dt.23-05-2019 2/2 2019 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Patna in connection with Special Case No.3412 of 2019 arising out of Budha Colony P.S.case No.121 of 2019.

With the above direction, this application is allowed.
