ANSARI ORAL ORDER 03-03-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accused-petitioner, namely, Raju Choudhary, in connection with Bairiya Police Station Case No. 232 of 2013, under Sections 4/5(g)/6 of the Protection of Children from Sexual Offences Act, 2012.

Perused the above application and materials on record.

Heard Mr. Bimlesh Kumar Pandey, learned Counsel for the petitioner, and Mr. Anish Chandra, learned Additional Public Prosecutor, appearing on behalf of the State. It is submitted that charges have already been framed by the learned trial Court and, hence, appropriate application for bail will be made in the learned trial Court

Patna High Court Cr.Misc. No.45997 of 2014 (3) dt.03-03-2015 2/2 and in the event, the bail application is not allowed, the petitioner may be given the liberty to apply for regular bail before this Court.

To the submission so made, no objection has been made by Mr. Anish Chandra, learned Additional Public Prosecutor, appearing on behalf of the State. In view of the above and in the interest of justice, this application shall stand disposed of as withdrawn with liberty as has been sought for.
