ANJANA MISHRA ORAL ORDER 16-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 12.8.2014 in Saharsa (Sadar) P.S.Case No.57 of 2014 for the offence under Sections 420,384 of I.P.C and 3(i),(x) of S.C.S.T. (P.O.A.) Act. It is submitted on behalf of the petitioner that he is the Head Clerk of the Department and six cases have been registered against him on the same day in collusion with the political person who had been denied the funding by the petitioner at the time of his election. It is further submitted that the allegation against him is that the Head Clerk of the department demanded his share for releasing their dues. It is further submitted that till date there has been no allegation against him on any count. The petitioner further submits that this Hon'ble Court had already pleased to grant bail
Patna High Court Cr.Misc. No.46261 of 2014 (3) dt.16-02-2015 2/2 to him in other cases having similar allegation vide order dated 4.2.2015 passed in Cr.Misc. No.45303/14, Cr.Misc. No.45916/14, Cr.Misc. No.45312/14 and also in Cr.Misc. No.45408/14 on 28.1.2015.
Considering the aforementioned submissions and also the fact that all cases are identical and the petitioner is retired employee, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Saharsa, in Saharsa (Sadar) P.S. Case No.57 of 2014.
