ANJANA MISHRA ORAL ORDER 25-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 07.10.2014 in connection with Saraiya P.S. Case No. 163/14 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is based on mere suspicion and the materials has come in the case diary that in fact the mental condition of the deceased Rajendra Ram was that he, after the death of his wife, himself committed suicide. The submission stands supported by the statement of the son of the deceased in paragraph No. 7 of the case diary.

Considering the fact that the petitioner has been in custody since 07.10.2014 and that he has no criminal antecedent and also

Patna High Court Cr.Misc. No.11126 of 2015 (3) dt.25-05-2015 P2/2 the fact that there is no cogent material in the case diary to implicate him in connection with the present case, let the petitioner Upendra Ram be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (West), Muzaffarpur in connection with Saraiya P.S. Case No. 163 of 2014.
