JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 Petitioner seeks bail in connection with Durgawati P.S. Case No. 66 of 2019 registered for the offences punishable under Sections 413, 414, 420, 400, 401, 201, 216A of the Indian Penal Code and Sections 25(1-B)(a) and 26 of the Arms Act. Prosecution story is that police raided the house of one Golu Singh @ Binit, who was wanted in another case, and when the police reached near his house, one accused person tried to flee away, who was arrested, who disclosed the name of Golu Singh @ Binit, who made confessional statement and on the basis of his confessional statement police raided the house of one Jaswant Singh and from his house five mobile phones were recovered and from the house of one Md. Riyasat, who has disclosed the name of the petitioner and other accused persons. Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.30878 of 2019(2) dt.23-05-2019 2/2 that though he has been named by co-accused but there is no recovered from his house or from his possession and he has no criminal antecedent and other co-accused persons have been granted bail vide order dated 17.5.2019 in Cr.Misc.No. 32821 of 2019 and vide order dated 6.5.2019 in Cr.Misc.No. 29079 of 2019 by co-ordinate Bench of this Court and petitioner is in custody since 9.3.2019.

In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S.Case No. 66 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
