The petitioner apprehends his arrest in a case registered under Sections 147, 148, 149, 295, 341, 323, 307, 504 and 506/34 of the Indian Penal Code.

Eight accused persons including the petitioner are said to have caught hold the informant on the way to his house and accused Shiv Shankar Kumar pressed his neck by means of leg and took out Rs. 4500/- from his pocket. On hulla they left the scene. But after a short while they again arrived at the village armed with deadly weapons and tried to disturb communal harmony.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner

Patna High Court CR. MISC. No.31111 of 2019(2) dt.10-05-2019 2/2 has no concern with the aforesaid occurrence. He has been falsely implicated in the case due to dirty village politics. No overt act has been attributed to the petitioner. Petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Sarai P.S. Case No. 102 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
