JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-03-2021 As prayed for, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 27.11.2020, within four weeks of starting of the Court proceeding in physical mode properly. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state.

The petitioners seek pre-arrest bail in connection with Basopatti P.S. Case No. 62 of 2020, registered under Sections 363 and 366A of the Indian Penal Code.

The accusation is that in the evening of 14.03.2020, grand-daughter of the informant, aged about 15 years, left the house without giving information. Later on, informant came to know that petitioners and Ramesh Sah have kidnapped the grand-daughter of the informant. At the time moving from the house, the grand-daughter of the informant has taken away

Patna High Court CR. MISC. No.32182 of 2020(2) dt.05-03-2021 2/2 ornaments and cash of Rs.20,000/- from house. Submission is that all the three petitioners are respectively father, mother and cousin brother of co-accused, Ramesh Sah. In fact, there was love affairs in between Ramesh Sah, who is son of petitioners 1 and 2, and grand-daughter of the informant and both left the house according to their own sweet will, but, informant, with ulterior motive, have implicated the petitioners also.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Basopatti P.S. Case No. 62 of 2020 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
