Petitioner is an accused in a case registered for the offence punishable under Sections 302, 201 & 34 of the Indian Penal Code.

It is alleged that the petitioner, being father-in-law of the deceased, burnt her to death with the help of other family members and village people, when she failed to bring cash of Rs. 5 lacs from her parents' house.

Learned counsel for the petitioner submits that the petitioner lives separately with his sons and has no concern with their routine activities. Further, the deceased had a daughter and a son, aged about 16 years and 14 years respectively, as such the allegation of demand of dowry seems to be improbable after a long period of marriage. In paragraph 12 of the bail petition, it is

Patna High Court CR. MISC. No.30666 of 2019(4) dt.18-09-2019 2/2 submitted that in fact the deceased committed suicide. Petitioner is in custody since 19.2.2019 having no criminal antecedent. Charge sheet has also been filed in the case, as such, there is no chance of tempering with the evidence.

Learned counsel for the informant vehemently opposes the prayer for bail.

In view of the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Belsand Police Station Case No. 24 of 2019 on the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
