The petitioner is languishing in custody since 05.08.2014 in a case registered for the offences punishable under Sections 395 of the Indian Penal Code, 25(1-B)a and 35 of the Arms Act.
In course of committing dacoity, one Arvind Vishwakarma was apprehended who disclosed the name of the petitioner as the person fleeing away from the place of occurrence. A supplementary affidavit has been filed to the effect that nothing has been recovered from the petitioner nor the petitioner has been put on T. I. Parade.
Considering the fact that the petitioner has not been put on T. I. Parade, let him, above named, be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.9145 of 2015 (2) dt.13-03-2015 2 / 2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Aurangabad, in connection with Dhibra P.S. Case No. 21 of 2014.
Since the petitioner has criminal antecedent, let the learned court below cancel the bail bond of the petitioner if he defaults for two consecutive occasions.
