The petitioner seeks bail in Khagaria (Muffasil) P.S. Case No. 168 of 2021, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on the alleged date and time of occurrence, co-accused Avinash Sah caught hold of informant and co-accused Santosh Sah fired upon him. This petitioner is alleged to have assisted co-accused Santosh Sah. It is submitted on behalf of the petitioner that specific allegation of causing firearm injury is against co-accused Santosh Sah. So far as, this petitioner is concerned, there is no allegation of any assault or causing firearm injury. Petitioner is in custody since 07.06.2021 having clean antecedent.

No.42484 of 2021(2) dt.28-10-2021 2/2 Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 168 of 2021.
