JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 380 and other ancillary sections of the Indian Penal Code. As per the prosecution case, this petitioner and his two associates were caught while attempting to commit theft of informant's motorcycle from outside his house. It is further alleged that on the disclosure of the petitioner, another stolen motorcycle was also recovered.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 1.12.2020. Investigation is complete.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.42619 of 2021(2) dt.17-01-2022 2/2 petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate West Champaran at Bettiah in Jogapatti Police Station Case No. 479 of 2020.
