The petitioner has renewed his prayer for bail in connection with Runnisaidpur P.S.Case No. 413 of 2013 registered for the offences punishable under sections 25(1-B)(a) and 26 of the Arms Act.
The prayer for bail of the petitioner was earlier rejected by this Court by order dated 23rd July, 2014 passed in Cr.Misc.No. 24568 of 2014 with the following observations :- "The learned Chief Judicial Magistrate, Sitamarhi, before whom the case is pending, is directed to expedite the trial of the petitioner and conclude the same as early as possible preferably within a period of six months from the date of receipt/production of a copy of this order failing which the petitioner would be at liberty to renew his prayer for bail."
Patna High Court Cr.Misc. No.15268 of 2015 (2) dt.15-04-2015 2/2 It has been contended that though the petitioner is in custody since 25th October, 2013 but till date not even a single witness has been examined on behalf of the prosecution in course of trial.
Regard being had to the observations made in the aforesaid order dated 23rd July, 2014 passed in Cr.Misc.No. 24568 of 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S.Case No. 413 of 2013.
