JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 Petitioner seeks regular bail in connection with Paraiya P.S. Case No.72 of 2016 registered for the offences punishable under Sections 447, 384, 379 & 34 of the Indian Penal Code and Section 17 of C.L.A. Act.
Allegation as per F.I.R. is that some miscreants came to the construction site of the informant and assaulted him and snatched the mobile phone and demanded Rangdari. Petitioner is not named in the F.I.R.
Submission of the learned counsel for the petitioner is that his name was transpired on the basis of confessional statement of co-accused Shankar Yadav and Shankar Yadav has been granted bail by a Co-ordinate Bench of this Court vide order dated 11.03.2019 passed in Criminal Misc. No.78942 of 2018. Further submission is that petitioner is in custody for
Patna High Court CR. MISC. No.30848 of 2019(2) dt.23-05-2019 2/2 more than eights months. Petitioner is accused in three other cases and one of them has been acquitted and in two other cases is on bail.
Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-III, Gaya, in connection with Paraiya P.S. Case No.72 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
