The petitioner seeks bail in a case under Section 364 and other sections of the Indian Penal Code.

The informant made allegation that the petitioner was kidnapping his minor daughter and while he was fleeing way with the minor daughter of the informant, the petitioner was intercepted and the victim girl was recovered. The victim also made her statement under Section 164 of the Code of Criminal Procedure stating that the petitioner was taking her to somewhere else. It is submitted that the petitioner happens to be the relative of the informant but there is nothing on record to show that the petitioner is the relative of the informant and there is a very specific allegation that the petitioner was kidnapping the minor daughter of the informant.
