Heard both parties.

The petitioner seeks bail in Uchakagaon P.S. Case No. 140 of 2021, registered for the offence punishable under Sections 307, 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner along with his four sons came at the door of informant armed with weapon and on the order of this petitioner other co-accused persons fired upon the informant party, as a result of which four persons sustained firearm injury and one of them succumbed to the injury.

It is submitted on behalf of the petitioner that there is no allegation of firing against this petitioner. Petitioner is

Patna High Court CR. MISC. No.43197 of 2021(2) dt.29-10-2021 2/2 alleged to be the order giver. Petitioner is in custody since 10.05.2021 having clean antecedent.

However, counsel for the State vehemently opposed the prayer for bail and submitted that four persons sustained firearm injury and one person died during course of treatment. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S. Case No. 140 of 2021.
