JUSTICE ASHUTOSH KUMAR ORAL ORDER 31-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Chand P.S. Case No. 201 of 2018 dated 25.09.2018 instituted for the offences under Sections 341, 323, 448, 307, 379, 504, 506, 34 of the Indian Penal Code.

The petitioner along with two others are said to have assaulted the mother of the informant over a dispute of a petty nature. Though the injury suffered by the mother of the informant is on her head but no definite opinion has been given about the nature of such injury.

The learned counsel for the petitioner has submitted that general allegation has been levelled against three accused persons and nothing specific has been attributed against him. The petitioner hails from the same village and the occurrence arose out of a small dispute. It

No.365 of 2019(2) dt.31-01-2019 2/2 has further been submitted that considering the futility of further litigating the matter, the informant does not wish to prosecute the petitioner any further and in support of the aforesaid contention, learned counsel for the petitioner has drawn the attention of this Court to a petition seeking permission to compound the case with the informant. Considering the aforestated facts and taking into account the clean antecedents of the petitioner, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vith, Kaimur at Bhabua in connection with Chand P.S. Case No. 201 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
