2. The petitioner has prayed for regular bail in connection with a case registered for the offence punishable under Section 309(4) of the BNS.

3. The case of the prosecution, in brief, is that unknown miscreants allegedly looted a sum of Rs.2,80,000/- along with a mobile phone from the informant and his friend.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the F.I.R. was initially lodged against unknown miscreants and, during the course of investigation, the spy disclosed the name of the petitioner, whereafter the petitioner is alleged to have made a confessional

Patna High Court CR. MISC. No.32327 of 2026(2) dt.13-05-2026 2/2 statement. It has further been submitted that one mobile phone and Rs.30,000/- were recovered from the possession of the petitioner. Learned counsel submits that the said mobile phone and cash belong to the petitioner himself. It is further submitted that no Test Identification Parade (T.I.P.) was conducted during investigation. Moreover, the petitioner is languishing in judicial custody since 15.01.2026 and has no criminal antecedent.

5. Learned APP appearing for the State has opposed the prayer for regular bail.

6. Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. Accordingly, the above-named petitioner is directed to be released on bail in connection with Kishanganj P.S. Case No. 31 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj/concerned Court.
