The petitioner seeks regular bail in a case under sections 376/511 and other allied sections of the Indian Penal Code.

The petitioner is alleged to have made attempt to commit rape with the victim lady i.e. the informant. Learned counsel for the petitioner submits that the petitioner is brother-in-law (Dewar) of the informant. Prior to lodging of the present case, the petitioner filed Complaint Case No. 2272 of 2013 against the informant and others. There is litigation between the parties and as such the petitioner has been falsely implicated in this case.

Considering the facts and circumstances of the

Patna High Court Cr.Misc. No.45546 of 2014 (2) dt.04-03-2015 case and the nature of allegation made against the petitioner and that the petitioner is in jail custody since 06.07.2014, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Samastipur in connection with Pusa P.S. case No.68 of 2014.
