The petitioner has prayed for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act. As per the prosecution case, a loaded country made pistol with six live cartridges was recovered from the petitioner's possession.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedents. The petitioner is in custody since 2.11.2021 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R together with the petitioner having remained in custody for over 1 year since 2.11.2021, the petitioner is directed to be enlarged on bail in connection with Alamnagar P.S. Case no. 215 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhepura.
