JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 This application, for grant of anticipatory bail, arises out of Tankuppa P.S. Case No. 117 of 2018, disclosing offences under Sections 302, 120(B)/34 of the Indian Penal Code. Allegation is of causing death of nephew of the informant.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and in fact the deceased died in road accident, which is evident from the inquest report prepared by the police. However, after fifteen days informant lodged this false and concocted case only on the basis of suspicion.

Having heard both sides, in view of the above facts. Let the petitioner, above named, in the event of his arrest or
Patna High Court Cr.Misc. No.80059 of 2018(3) dt.04-02-2019 2/2 surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Gaya, in connection with Tankuppa P.S. Case No. 117 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
