The petitioner, who is in custody since 10.06.2020 seeks bail in connection with Spl. Case No. 80/2019 arising out of Phulwarisharif P.S. Case No. 443 of 2019 instituted for the offences under Sections 354C, 385, 387, 506/34 of the Indian Penal Code and Sections 8/12 of the POCSO Act. The petitioner is said to have taken photograph of the victim who is a minor and has been threatening to make such objectionable photographs viral.

Learned counsel for the petitioner has submitted that an absolutely false allegation has been levelled against

Patna High Court CR. MISC. No.33450 of 2020(3) dt.02-02-2021 2/2 him. In fact, the petitioner as well as the victim were closely associated with each other as friends but only because of not performing the marriage as desired by the parents of the victim, the present case has been lodged.

Regard being had to the nature of accusation against the petitioner, I am not inclined to grant bail to him for the present.

The prayer for bail is rejected.
