9 kg ganja is said to have been recovered from the house of the petitioner but submission on behalf of the petitioner is that he was not aware about institution of the present case and, as a matter of fact, nothing has been recovered from his possession. It is further contended by him that the petitioner was remanded in this case on 30.1.2015 and since then he is languishing in jail custody. It is further contended by him that co-accused Baleshwar Singh and Babulal Yadav, from whose possession huge quantity of ganja are said to have been recovered, have already been granted privilege of bail by a coordinate bench of this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that having more or less similar allegation some co-accused are enjoying

Patna High Court Cr.Misc. No.17357 of 2015 (3) dt.03-09-2015 privilege of bail, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge, Patna in Special case no. 18B/2004 rising out of Bakhtiyarpur P.S.
