JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This is an application for grant of anticipatory bail in connection with Daraundha P.S. Case No. 181 of 2018, disclosing offences under Sections 420, 406 of the Indian Penal Code and Section 138 of N.I. Act.
Allegation against the petitioner is of taking the cash of Rs.1,40,000/- and Rs.55,500/- of cloth, kithen and other things and for that the petitioner has issued a cheque, but thereof stopped the payment due to which the payment was not made. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case, but after some argument he is ready to return the money, if a reasonable time is granted to the petitioner. Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the court below within a period of eight weeks along with a bank draft of Rs.56,000/- and on his surrender, the court below shall release the petitioner on provisional bail for a period of five months to his own satisfaction with condition that he will deposit rest of the due amount in five equal installments payable on the first week of each month and once the whole amount is deposited, the court below shall confirm the provisional bail of the petitioner, otherwise he is free to pass any order or orders as he deems fit and proper.
It is needless to say that the amount so deposited will subject to outcome of the case and may be released in favour of informant on his applicaton.
