ANJANA MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 30.6.2014 in Raxaul P.S. Case No.149/14 for the offence under Sections 394, 395 and 397 of the I.P.C.

It is submitted on behalf of the petitioner that the F.I.R. in this case was lodged against unknown persons but subsequently on the basis of mere suspicion he was taken into custody and excepting the personal mobile of the petitioner nothing has been recovered from his conscious possession. It is submitted that test identification parade has not yet been conducted, though the informant has stated that he could well recognize the miscreants.

No.45316 of 2014 (3) dt.03-03-2015 2/2 Considering the aforementioned submissions and also the fact that the petitioner has been in custody since 30.6.2014 having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Raxaul at Motihari, in Raxaul P.S. Case No.149/14 corresponding to G.R.No.496/14.
