The petitioners seek bail in Assaon P.S. Case No. 28 of 2014, registered for the offences punishable under Sections 498(A), 304(B), 201 and 120B of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The brother of the deceased Suggi Devi alleged that his sister was married to Mithun Ram and within three months she was killed and her dead body was tied with a piece of stone and dropped in a well.

Learned counsel for the petitioners submits that the petitioners are mother-in-law and father-in-law of the deceased. No specific allegation of demand of dowry and torture is made against the petitioners. The petitioners are living separately.

Patna High Court Cr.Misc. No.45407 of 2014 (4) dt.15-04-2015 2/2 Similarly situated accused persons namely Sunita Devi and Laljhariya Devi @ Phuljhariya Devi have been enlarged on bail vide Cr. Misc. No. 41041 of 2014 and Cr. Misc. No. 41859 of 2014. The petitioners are in jail for last 10 months. Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Assaon P.S. Case No. 28 of 2014.
