====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 19-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 379/304 of the Indian Penal Code. Later on offences were converted under Sections 394/302 of the Indian Penal Code.

The petitioner is in custody since 15.10.2018. The FIR was registered against unknown. At the belated stage of the investigation evidence came that co-accused Chamru and petitioner were seen near the place of occurrence at the time of occurrence.

The Court-below refused the prayer for bail considering the criminal antecedent of the petitioner.

No.32913 of 2020(3) dt.19-03-2021 2/2 Since there is no material against the petitioner in this case for the purpose of his further detention as under trial prisoner as well as considering the fact that investigation of the case is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mokama (Hathidah) Rail P.S. Case No.28 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
