JUSTICE AMARESH KUMAR LAL ORAL ORDER 24-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek bail in a case registered for the offence punishable under Sections 25(1-b)A, 26, 35 of the Arms Act.

The allegation is that one country made loaded pistol was recovered from the possession of petitioner no. 1 and four live cartridges were recovered from the possession of petitioner no. 2. Both of them are in custody since 28.07.2014. Learned Additional Public Prosecutor for the State submits that the petitioners have also criminal antecedents.

Patna High Court Cr.Misc. No.10105 of 2015 (2) dt.24-04-2015 Considering the facts and circumstances, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger/court concerned in connection with Kharagpur P.S. Case No. 171 of 2014 after framing of charge with following conditions:-

(1) The petitioners will not indulge himself in similar or any other offence.

(2) One of the bailors must be the close relative of the petitioners.

(3) The petitioners will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, their bail bonds would be liable to be cancelled by the learned Court concerned.
