Mr. Asharaf Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This is an application for grant of anticipatory bail in connection with Warisaliganj P.S. Case No. 203 of 2016, disclosing offences under Sections 364, 365, 34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of kidnapping the husband of the informant and thereafter he traceless.
Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner. Further, he has no criminal antecedent. Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner stating that it is the petitioner and other coaccused persons who have taken the husband of the informant and thereafter he is traceless.
Patna High Court Cr.Misc. No.1398 of 2019(2) dt.22-01-2019 2/2 Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
