2. The application has been filed alleging non compliance of the order dated 15.01.2014 passed in CWJC No. 16843 of 2013.

A show cause has been filed on behalf of the opposite parties no. 2 and 3 (Commission) which discloses that pursuant to the direction of the writ Court, the matter was considered and recommendation has been made only of persons who had the required qualification till the session 1981-82. It was submitted that admittedly, the petitioner is of a latter session and, thus, the recommendation for all posts having been made, the petitioner stands excluded.

4. Learned counsel for the petitioner submitted that the Commission has wrongly noted in its records that the session of the petitioner was 1983-84, though actually it is 1982-83. It was submitted that the application for correction of the session has not been considered.

5. Having considered the matter, the Court finds that since for all the posts recommendations have already been made, that too, in view of a special exercise carried pursuant to the order of the Hon'ble Supreme Court, such grievance of the petitioner may not be relevant. However, the Court would observe that if in future, the authorities move beyond session 1981-82, the

Patna High Court MJC No.1175 of 2016 dt.22-07-2019 3/3 consideration of the petitioner's case shall be on the basis of him having cleared the qualification in the session 1982-83, upon proper verification in this regard and in accordance with law.

6. The application stands disposed off.
