JUSTICE RAVI RANJAN ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in a case registered for offences punishable under Sections 406, 420, 120B, 392 and 411/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that he had lodged Gobindganj Police Station Case No. 25 of 2014 for the theft of his motorcycle in which a sum of Rs. 2,50,000/- was kept and the motor cycle was recovered and, thereafter, the petitioner filed a petition for release of the aforesaid money in his favour. It is further submitted that the petitioner has been implicated by the police in the present case only on the allegation that he had suppressed or concealed the fact that he had kept huge amount also in the motorcycle. The petitioner claims that his antecedent is clean except that in a case he was involved in case in Nepal when

Having regard to the facts and circumstances of the case, the petitioner, namely, Balmiki Kumar, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, at Motihari in Gobindganj Police Station Case No. 105 of 2014.
