JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code. As per the prosecution case, this petitioner is said to have given Dab blow on the head of the brother of the informant causing injury on his head.

Learned counsel for the petitioner submits that there is a case and counter case. Doctor has found the injury caused to the brother of the informant to be caused by hard and blunt substance and thus the same belies the prosecution case. Petitioner has claimed clean antecedent and he is in custody since 15.1.2021.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.43334 of 2021(2) dt.18-01-2022 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, East Champaran at Motihari in Pakridayal Police Station Case No. 10 of 2021.
