Petitioner is in jail custody since 8.2.2015 in a case registered under section 394 of the Indian Penal Code. Petitioner was neither caught on the spot nor anything was recovered from his conscious possession.

Co-accused Pappu Kumar, who was caught on the spot, has already been granted privilege of bail on the ground of juvenile. Moreover, petitioner does not have any criminal antecedent. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Bathnaha P.S.
