2. The petitioner has preferred this application for grant of regular bail in connection with Sugauli P.S. Case No. 324 of 2024 dated 20.07.2024 registered for the offences punishable u/ss 126(2), 115, 118(1), 109, 74, 303(2), 352 read with section 3(5) of the BNS.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have come at the land of informant and tried to take Tripaal and Tin. On being objected, the accused persons started abusing and one Ramadhar Singh assaulted informant's son Upendra Bhagat with Farsa on his head, due to which he received injury and fell down on the

When the informant went to save him, then all the accused persons assaulted her and dashed her also, due to which she became semi-naked. When the informant's another son Santosh Bhagat came to save her, the co-accused Ajay Bhagat assaulted him with Knife on his stomach causing injury, became unconscious and fell down on the ground. The accused persons also snatched Payal and Mangalsutra worth of Rs. 20.000/- from the informant. Thereafter, the informant's son Santosh Kumar was brought to Sadar Hospital, Motihari.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 13.05.2025 passed in Cr. Misc. No. 1909 of 2025. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.01.2025.

5. Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the injury is stated to

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran at Motihari in connection with Sugauli P.S. Case No. 324 of 2024.

7. The application stands allowed.
