JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 The petitioner is languishing in custody since 13.01.2015 in connection with Jaynagar P.S. Case No. 246 of 2013 for the offences instituted under section 7 of the Essential Commodities Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on the date of occurrence, the S.D.O., Jaynagar raided and seized five gas cylinders and Kerosene Oil from the premises of Tandoor Hotel. It is submitted on behalf of the petitioner that the petitioner has no criminal antecedent and he is in custody since 13.01.2015. It is further submitted that the petitioner runs a Dhaba by the side of the road for earning his livelihood and from there it

Patna High Court Cr.Misc. No.15938 of 2015 (2) dt.09-06-2015 is alleged that five Gas Cylinders were recovered. It has been further submitted that co-accused Jivachh Sah @ Jibachh Sah has been granted bail by another Bench of this Court by order dated 08.04. 2015 vide Criminal Misc. No. 11898 of 2015. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Madhubani in connection with Jaynagar P. S. Case No. 246 of 2013.
