Informant, who happens to be attached with western union money transfer was intercepted by the unknown criminals and on the pretext of firearm he was robbed of containing of Rs.6 lacs, cheques, other documents. It is evident from the case diary that petitioner was apprehended along with Mukesh Yadav on account of their suspicious activities and during course of interrogation the petitioner had confessed and further disclosed that after taking out the money from bag, they have thrown the same within the campus of abandoned Pachrukhi Sugar Mill which was accordingly recovered and for that seizure list was prepared as is evident from paras-25, 26 of the case diary. However, neither the bag nor the papers recovered therefrom interlinked nor the same has been put on T.I. parade and in likewise manner petitioner was also not put on Test Identification Parade. It is also apparent from the case diary that petitioner has been remanded subsequently in cases one by one.
Patna High Court Cr.Misc. No.45460 of 2014 (4) dt.03-04-2015 Accordingly, petitioner Vickky Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No.144 of 2014.
