Petitioner seeks regular bail in connection with Sarmera P.S. Case No. 22 of 2020 registered for the offence under Section 379 / 411 / 34 of the I.P.C.

As per the first information report she buffalo of the informant was stolen and the same was being loaded on a Pick Up Van and some of the accused persons were apprehended by villagers and the petitioner had fled away after resorting to firing.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he has falsely been implicated in this case due to village politics. He further submits

No.43882 of 2021(2) dt.04-02-2022 2/2 that the co-accused persons who were arrested / apprehended at the place of occurrence have been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 17046 / 2020 , petitioner is in custody since 25 / 4 / 2021 and charge sheet has already been submitted.

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, the co-accused persons have been granted bail by a Co-ordinate Bench of this court, petitioner is in custody since 25 -4-2021 and charge sheet has already been submitted as such, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Mr. Ashish Ranjan, J.M. 1st Class, Bihar Sharif, Nalanda in connection with Sarmera P.S. Case No. 22 of 2020.
