2. The petitioner is in custody in connection with Moro P.S. Case No. 01 of 2024 registered for the offences punishable under Sections 427, 436, 307, 326, 120(B) and 34 of the Indian Penal Code.

3. As per the allegation made in the First Informant Report, it is a case of putting fire by some miscreants in the police barrack.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner has surfaced in this case on the basis of confessional statement of the co-accused person namely Dharmendra Thakur and there is no recovery from the possession of petitioner and petitioner is in jail since 15.01.2024 and other

Patna High Court CR. MISC. No.38087 of 2024(2) dt.22-05-2024 2/2 co-accused person has already granted bail by the Court of learned District and Sessions Judge, Darbhanga vide order dated 18.04.2024 passed in B.P. No. 291 of 2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the First Information Report, impugned order dated 16.03.2024 and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge 3rd , Darbhanga in connection with Moro P.S.
