JUSTICE AMARESH KUMAR LAL ORAL ORDER 27-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 365/34 of the Indian Penal Code. The allegation against the petitioner and his relatives is that they have caused to disappear the daughter of the informant. It is submitted that only suspicion has been made and in the similar facts and circumstance co accused Anil Sahni, husband of the victim, has already been granted bail vide order dated 21st March, 2014 passed in Cr. Misc. No. 46022/2013 and the petitioner has no criminal antecedent.
Considering the facts and circumstances, the above named petitioner, Sunil Sahni, is directed to be released on bail on
Patna High Court Cr.Misc. No.7037 of 2015 (2) dt.27-02-2015 2/2 furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri R.K. Bharti, the learned Judicial Magistrate 1st class, Motihari, East Champaran in connection with Mehasi P.S.Case No. 272/2011 with following conditions :- I) One of the bailors will be the close relative of the petitioner.
II) The petitioner will not indulge in similar or in any other offence.
III) The petitioner will be well represented in the Court.
IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
