2. The petitioner is in custody since 27.04.2014 in connection with Barh P.S. Case No. 272 of 2012 for the alleged offences under Section 414 IPC.

3. It is submitted that the petitioner has been falsely implicated only on the confessional statement of coaccused and he has not named in the FIR as one of the four persons said to be making away with the truck. It is further submitted that the FIR named co-accused Triloki Rai @ Sipahiji has been granted bail by this Court in Cr. Misc. No. 33711 of 2013. From perusal of a copy of the relevant bail

Patna High Court Cr.Misc. No.46151 of 2014 (3) dt.04-02-2015 order dated 20.09.2013 passed in that case, it appears that other three co-accused have also been granted bail by the learned Ist Additional Sessions Judge, Barh as well.

5. Having regard to the entirety of the facts and circumstances, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 272 of 2012 with the following conditions1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the Court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
