The petitioner is apprehending his arrest in connection with Kanti P.S.case No.518 of 2018 registered for offences punishable under Sections 366(A)/34 of the Indian Penal Code. This application has been filed for cancellation of the bail granted to O.P.no.2 vide order dated 17.9.2018 passed by Sessions Judge, Muzaffarpur in ABP No.2821 of 2018 and the grounds for cancellation of the bail is that after release on bail he had again forcibly taken away the daughter of the informant, who is a minor girl.

On perusal of the order it appears that so far this case is concerned, this is a case under Sections 354, 365, 366(A)/34 of

Patna High Court CR. MISC. No.1424 of 2019(3) dt.12-03-2019 2/2 the IPC and on recovery, the statment of the girl has been recorded and she disclosed that her mother assaulted her due to which she went to the house of her maternal-grand-father and as such she has not supported the prosecution case and given a complete go-by to that case.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I find no materials to cancel the anticipatory bail already granted to the petitioner, as such this case is dismissed.
